1. Acceptance of Terms

By accessing or using the Elysian service ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Elysian ("we", "us", "our").

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Elysian is an AI-powered informational assistant that provides knowledge related to survival, navigation, field medicine, and tactical operations, based on publicly available military doctrine and survival literature. The Service is provided via a web interface and is accessible upon registration and payment of a one-time access fee.

3. Eligibility

You must be at least 18 years of age to use this Service. By registering, you confirm that you meet this requirement. Elysian is intended for legal use only and may not be available in all jurisdictions.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We reserve the right to terminate accounts that violate these Terms.

You may not share your account credentials or allow third parties to access the Service through your account.

5. Payment and Access

Access to the full Service requires a one-time payment ("Lifetime Access"). All prices are displayed inclusive of applicable taxes. Payments are processed securely via Stripe.

Pursuant to Article 16(a) of Directive 2011/83/EU on Consumer Rights, you acknowledge that the right of withdrawal does not apply to digital content that has been fully delivered and to which access has been granted immediately after payment, provided you have given your prior express consent and acknowledged the loss of the right of withdrawal.

In all other cases, consumers within the European Union have the right to withdraw from a purchase within 14 days of the transaction, provided the digital content has not been accessed. To exercise this right, contact us at the address set out in Section 11.

6. Acceptable Use

You agree not to use the Service to:

• ▸Violate any applicable law or regulation, including EU and national law
• ▸Plan, assist in, or carry out any illegal activity
• ▸Attempt to reverse-engineer, scrape, or extract the underlying knowledge base or AI model
• ▸Circumvent any rate limits, access controls, or authentication mechanisms
• ▸Share, resell, or redistribute access to the Service
• ▸Submit content that is harmful, threatening, or abusive

We reserve the right to suspend or terminate access without notice for violations of this section.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Elysian does not warrant that the information provided is accurate, complete, current, or suitable for any specific purpose.

The information provided by Elysian is for educational and informational purposes only. It is not a substitute for professional military training, certified wilderness guides, licensed medical practitioners, or other qualified professionals. You assume full responsibility for any decisions made based on information provided by the Service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Elysian shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to personal injury, loss of data, or loss of profits, arising from your use of or reliance on the Service.

Where EU consumer protection law applies, nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Intellectual Property

All content, design, trademarks, and software comprising the Service are the intellectual property of Elysian or its licensors and are protected by applicable intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service solely for personal, non-commercial purposes.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the European Union and the applicable national law of the member state in which we are established. Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes may be referred to the competent courts of the relevant jurisdiction.

EU consumers also have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
